1. Definitions

• Clone Owner: A user who creates and manages an AI clone on the platform.
• End-User: Any person who interacts with an AI clone by submitting queries.
• Knowledge Content: Text, documents, and materials uploaded by a Clone Owner.
• Query: A single interaction or conversation exchange with an AI clone.

2. Account Terms

• You must be at least 18 years of age to use the Service.
• You must provide accurate, complete information during registration and keep it updated.
• You are responsible for maintaining the confidentiality of your credentials and all activity under your account.
• Notify us immediately at support@clonify.in if you suspect unauthorized access.
• One person or entity may not maintain more than one free account.

3. Acceptable Use

You agree not to use the Service to:

• Upload or distribute illegal, defamatory, obscene, harassing, or infringing content.
• Create AI clones that impersonate another person without their explicit consent.
• Generate content promoting violence, discrimination, or hatred.
• Distribute medical, legal, or financial advice without appropriate disclaimers.
• Reverse-engineer, decompile, or extract underlying models or algorithms.
• Use automated tools (bots, scrapers) without prior written consent.
• Circumvent rate limits, security measures, or access controls.
• Resell, sublicense, or redistribute the Service without authorization.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Service Availability

• We strive for high availability but do not guarantee uninterrupted operation.
• Scheduled maintenance may cause temporary unavailability with reasonable advance notice.
• Third-party provider outages may affect Service availability.
• We may modify, suspend, or discontinue features at any time.

7. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided “as is” without warranties of any kind.
• Clonify is not liable for indirect, incidental, special, or consequential damages.
• Total aggregate liability shall not exceed the amount you paid in the 12 months preceding the claim.
• We are not liable for the accuracy of AI-generated responses.

8. Indemnification

You agree to indemnify and hold harmless Clonify from any claims arising from your use of the Service, your Knowledge Content, or your violation of these Terms or third-party rights.

9. Termination

• You may delete your account from Settings or by contacting support@clonify.in.
• We may suspend or terminate accounts that violate these Terms or engage in fraud.
• Upon termination, your data will be deleted within 30 days unless retention is required by law.
• Sections on IP, Liability, Indemnification, and Governing Law survive termination.

10. Dispute Resolution

Disputes should first be resolved informally via support@clonify.in. If unresolved within 30 days, either party may pursue formal resolution per Section 11.

11. Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

12. Changes

We may revise these Terms from time to time. Material changes will be notified via email or on this page. Continued use after changes constitutes acceptance.

13. General

• Entire Agreement: These Terms, with our Privacy Policy and Refund Policy, constitute the entire agreement.
• Severability: If any provision is unenforceable, the rest remain in effect.
• Waiver: Failure to enforce a provision does not waive it.
• Assignment: You may not assign your rights without our consent. We may assign freely.
